A child born by a surrogate using reproductive technologies ensured to an infertile couple at a specialized clinic shall be deemed a child of this couple even if donor oocytes (egg and sperm) were used for conception.

CAN A SURROGATE BE INSEMINATED WITH HER PARTNER’S SPERM?

Absolutely not. This is forbidden by law, because in essence the woman is giving up her own child. Taking into consideration that there is a fee for participation in the programme, this means that the woman would be selling her own child, which is against the law and all existing ethical norms.

Even if the woman agrees to sign a completely voluntary relinquishment at the maternity hospital, it gives no guarantees to the parents of the child, because she is the mother of the child, and she has every right to keep it. Even if she gives up the child, the spouse of the man whose sperm was used for insemination will simply have to adopt her own husband’s child.

Therefore, if a woman cannot provide her own egg for any reason, she must use donor material to conceive. This is the only way surrogacy will not force the woman to give up her own child.

I AM A MAN WHO LIVES ALONE. CAN I USE A SURROGATE?

The right to procreation is an inalienable part of any person’s rights. After the latest amendments to the law on reproductive technologies, single men and women can use the full range of reproductive technologies in order to have children. In the case of a man, a donor’s egg and a man’s sperm are used. However, the surrogate mother cannot be an egg donor at the same time in order to avoid serious legal problems.

When registering such a child, the man can leave a dash in the column “mother” or use his surname, adding his first and patronymic name as he sees fit.
